Menu99 Terms of Service
Last Updated: 27 October 2026 | Applicable to all Merchants, Outlets, and End-Customers
1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, or “Merchant”) and Menu99 (“Menu99”, “we”, “us”) governing your access to and use of menu99.in, QR-code interfaces, kitchen consoles, and merchant POS software (collectively, the “Platform”).
By accessing the Platform or placing an order, you confirm that you have read, understood, and agreed to these Terms and the incorporated Privacy Policy.
2. Nature of Menu99: Pure Technology Service Provider
Menu99 operates exclusively as a Software-as-a-Service (SaaS) and technology facilitator. Menu99 is NOT a restaurant, caterer, food preparer, cloud kitchen operator, delivery agent, or food seller.
The contract for the preparation, packaging, cooking standards, allergy prevention, hygienic handling, and handover of food items is strictly and solely between the end-customer and the independent Merchant.
3. Menus, Pricing & Allergen Representations
All menu catalogs, product descriptions, ingredient classifications (e.g., Pure Veg vs. Non-Veg indicators), pricing, taxes, and turnaround estimates displayed on the Platform are configured and maintained independently by the participating Merchant.
- Illustrative Imagery: Food photographs, serving representations, and menu banners are illustrative of culinary preparations. Actual presentation and portioning may vary based on merchant preparation.
- Food Allergies & Dietary Guidance: Customers with specific food allergies, celiac sensitivities, or dietary restrictions must directly communicate with the merchant counter before ordering. Menu99 assumes zero responsibility for unindicated allergen reactions.
- Dynamic Price Updates: Menu prices, applicable packaging levies, and GST charges are determined by the Merchant and are confirmed at checkout.
4. Order Placement & Kitchen Acceptance
Transmitting an order through a table QR or counter terminal constitutes an order request. An order is formally confirmed once accepted by the Merchant's kitchen display or counter terminal.
In instances where an ordered dish is sold out (Item 86) or the stall/cafe is operating beyond capacity, the merchant reserves the statutory right to decline or modify the order with appropriate reimbursement as outlined in our Refund Policy.
5. Payments & Settlements
Payments executed via digital QR or integrated gateways are handled through certified third-party payment aggregator networks.
- Customers must never disclose UPI PINs, Netbanking passwords, or OTPs to restaurant personnel or Menu99 staff.
- Counter cash transactions are settled in-person directly between the customer and merchant staff; Menu99 assumes no custodial liability for physical cash disputes.
6. Comprehensive Merchant Obligations
Food businesses operating on Menu99 represent and warrant that they:
- Possess active statutory food licenses, including valid FSSAI registration, municipal health trade permits, and GST registrations where applicable.
- Prepare, preserve, cook, and pack all food in strict conformance with the Food Safety and Standards Act, 2006.
- Maintain real-time menu accuracy and prompt order statuses.
- Treat customer contact details acquired through Menu99 with strict confidentiality and never repurpose them for unsolicited messaging.
- Indemnify and hold Menu99 harmless from any third-party claims, health notices, food adulteration allegations, or consumer disputes arising from their culinary offerings.
7. Comprehensive Limitation of Liability
To the maximum extent permissible under Indian Law:
- Menu99 shall NOT be liable for any direct, indirect, punitive, or consequential damages resulting from food taste, food contamination, illness, merchant preparation delays, or physical dining disputes.
- Menu99 does not guarantee 100% uninterrupted platform access during third-party telecom blackouts, payment gateway outages, or cloud infrastructure downtimes.
- In any event, Menu99’s aggregate liability to any user or merchant shall not exceed the technology platform subscription fee paid by that party in the preceding thirty (30) days.
8. Acceptable Use Standards
Users and merchants shall not:
- Submit fraudulent or fictitious counter orders.
- Reverse-engineer, decompile, or harvest proprietary application code or API protocols.
- Transmit malicious payloads, bot scrapers, or software exploits.
9. Intellectual Property
The Menu99 trademark, software architecture, UI layouts, vector assets, and brand assets are the exclusive intellectual property of Menu99 Technologies Inc. Merchants retain ownership of their proprietary logos and menus uploaded to the system.
10. Dispute Resolution & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any legal dispute, arbitration, or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India.
